What happens if someone passes away without a will in Malaysia?

Where there is no will, the estate is distributed under the Distribution Act 1958 (for non-Muslims) or the relevant syariah law provisions (for Muslims). The court appoints an administrator to manage the process. We can guide your family through this, from applying for letters of administration to the final distribution of assets.

How long does the probate process typically take?

Timelines vary depending on the complexity of the estate and whether there are any disputes. A straightforward estate with a valid will can often be administered within four to eight months. More complex matters involving multiple assets or contested claims will naturally take longer. We will give you a realistic estimate after reviewing the circumstances.

What documents will I need for an initial consultation?

It helps to bring a copy of the will (if one exists), the MyKad of the deceased and of the primary beneficiaries, and a rough list of assets and liabilities. If you do not have all of these, that is perfectly fine — we will explain what to gather as we go.

Can Menara Adil assist with both Muslim and non-Muslim estate matters?

We handle non-Muslim estate matters under the civil jurisdiction — wills, probate, and the Distribution Act. For Muslim estate matters (faraid), which fall under syariah jurisdiction, we can refer you to the appropriate bodies and work alongside qualified syariah practitioners where required.

What are your fees, and are there any hidden charges?

Our fees are set out plainly from the outset. Estate Planning Consultations start from RM 275, Probate and Administration from RM 695, and Dispute Resolution from RM 1,460. Court filing fees and disbursements are listed separately. There are no charges you will not know about in advance.

Is it possible to handle everything remotely, or do I need to visit your office?

Many matters can be discussed by phone or video call, and documents can be exchanged securely online. Some steps — such as signing statutory declarations — do require an in-person visit. We will let you know in advance when that is needed and keep travel to our office to a minimum.
