  • "Engagement Letter" refers to the written letter we issue to a client before commencing work, setting out the scope, fees, and terms of the specific retainer.
  • "Agreement" refers to these Terms and Conditions together with any Engagement Letter.

2. Acceptance of Terms

  • By accessing this website or submitting an enquiry, you confirm that you are at least 18 years of age and have the legal capacity to enter into binding agreements.
  • If you are using this website or engaging our services on behalf of another person or entity, you confirm that you have authority to do so and that the other party is bound by these terms.
  • Use of this website constitutes acceptance of these terms. Formal engagement of our legal services is additionally governed by the Engagement Letter issued to you.

3. Description of Services

Menara Adil provides legal services in the area of succession and estate law in Malaysia, including:

  • Estate planning consultations, including will drafting and advice on asset distribution
  • Probate and estate administration, including applications for grants of probate and letters of administration
  • Inheritance dispute resolution, including negotiation, mediation, and court representation

Our services are available to individuals and families in Malaysia. The website is available globally for informational purposes, but our legal practice is limited to matters governed by Malaysian law.

4. User Responsibilities

When using this website, you agree to:

  • Provide accurate, complete, and current information when making enquiries or engaging our services

6. Fees and Payment

  • Our professional fees are set out in the Engagement Letter provided to you before work begins. Indicative fees are also shown on our website.
  • All fees are quoted and payable in Malaysian Ringgit (RM).
  • Court filing fees, stamp duty, and third-party disbursements are charged in addition to professional fees and are listed separately in your Engagement Letter.
  • Payment is required in accordance with the payment schedule in your Engagement Letter. We reserve the right to pause work on a matter if agreed payments are not made.
  • Fee refund requests are considered on a case-by-case basis depending on the stage of the matter. Work already carried out is not generally refundable.

7. Service Delivery Terms

  • The specific scope, timeline, and deliverables for each engagement are set out in the Engagement Letter and may vary depending on the complexity of the matter.
  • We will carry out work with reasonable skill and care, in accordance with our professional obligations under the Legal Profession Act 1976 and Bar Council rules.
  • Timelines given are estimates based on our experience and current court or registry practices. Delays caused by courts, registries, third parties, or circumstances outside our control are not within our responsibility.
  • Any material change to the scope of work requested by you may result in a revised fee estimate, which will be agreed before additional work is carried out.
  • Our legal advice is provided on the basis of Malaysian law as it stands at the time of advice. We are not responsible for subsequent changes in the law unless you have engaged us to monitor your matter on an ongoing basis.

8. Disclaimers

  • The information on this website is provided for general informational purposes only and does not constitute legal advice. You should not act on information from this website without first obtaining professional advice tailored to your specific circumstances.
  • We do not make any representations about the outcome of any legal matter. Legal proceedings involve uncertainty and no result can be assured.

  • Force majeure: We will not be in breach of these terms where our failure to perform is caused by circumstances beyond our reasonable control, including court closures, government directives, or natural events.

10. Termination of Engagement

  • You may terminate your engagement with us at any time by written notice. Fees for work already carried out will remain payable.
  • We may terminate or suspend our engagement if you fail to provide information or instructions needed to progress the matter, if fees remain unpaid, if a conflict of interest arises, or if continuing the engagement would require us to act contrary to our professional obligations.
  • On termination, we will provide you with a summary of the current status of your matter and return documents you have provided to us upon request.
  • Sections of these Terms relating to confidentiality, intellectual property, payment, and limitation of liability survive termination.

11. Governing Law and Disputes

  • These Terms and Conditions are governed by the laws of Malaysia.
  • Any dispute arising from your use of this website or our services shall be subject to the exclusive jurisdiction of the courts of Malaysia, with Kuala Lumpur as the agreed seat.
  • Before initiating any formal proceedings, we encourage parties to first attempt to resolve disputes through direct discussion. Please contact us at [email protected] in the first instance.
  • If you have a complaint about our services, we will attempt to resolve it internally. If unresolved, you may refer the matter to the Disciplinary Board of the Malaysian Bar in accordance with the Legal Profession Act 1976.

12. General Provisions

  • Entire Agreement: These Terms, together with the Engagement Letter issued for your specific matter, constitute the entire agreement between you and Menara Adil in relation to the subject matter covered.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
  • Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
  • Notices: Legal notices under these Terms may be sent by email to [email protected] or by post to our Jalan Semarak office.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised "Last Updated" date. For matters already in progress under an existing Engagement Letter, the terms in force at the time of engagement apply unless both parties agree otherwise.
